„Egyszerű” bejelentési eljárás (folytatás)

Az egyik legfontosabb változás, hogy az egyszerű bejelentés NEM hatósági eljárás. Vagyis nem kell illetéket fizetnie a bejelentő személynek. Mivel nem hatósági eljárásról beszélünk, negatív elbírálás esetén bármennyi új bejelentés tehető, amennyiben valamilyen hiányosságot állapít meg a hatóság.

A benyújtandó dokumentumok formai követelményei is változtak. Egy „csökkentett” tervanyagot kell beadni az építészeknek. Ez a csökkentés nem jelenti azt, hogy nem kell elegendő mélységig megterveztetni a házat, csupán a hatóság által ellenőrzött dokumentáció mennyisége csökken. Házunknak továbbra is meg kell felelni a hatályos jogszabályoknak, követelményeknek, be kell tartanunk a szakhatóságok (örökségvédelem, tűzoltóság, stb.) előírásait. Mivel az építési hatóság ezeket a megfeleléseket már nem ellenőrzi teljes körűen (pl: nem kér a hatóság energetikai számítást, viszont az energetikai követelményeknek meg kell felelni) nő az építtető és a tervező felelőssége. Szabálytalan építés esetén súlyos bírságra kell számítani.

A fentiek alapján jogos a felvetés: Valóban „egyszerű” a bejelentés?
